Refinancing in Georgia: What It Actually Costs in 2026

Most refinance articles tell you to watch rates. That is the easy part. The part that decides whether a refinance is worth doing is what it costs to get there — and Georgia has cost rules that national calculators get wrong.

Refinancing in Georgia typically costs between 2% and 5% of the loan amount in closing costs, and Georgia adds two state-specific charges most calculators miss: the intangible recording tax on your new security deed and the attorney fee required because Georgia mandates attorney-conducted closings. The intangible tax runs $1.50 per $500 of the loan amount, capped at $25,000, and one important exemption can eliminate it entirely.

What are the closing costs to refinance in Georgia?

That last row matters for honest math. Prepaids and escrow funding get lumped into “closing costs” on your statement, but they are money you would owe regardless. When you calculate whether a refinance pays off, count the fees, not the escrow.

Do you pay intangible tax on a refinance in Georgia?

Georgia charges an intangible recording tax on long-term notes secured by real estate. The rate is $1.50 for each $500 of the face amount of the note, or any fraction of it, with a maximum of $25,000 on any single note (Georgia Department of Revenue, 2026).

On a $300,000 refinance, that is $900. Not enormous, but not nothing.

The exemption. Georgia does not require intangible tax on the portion of a new long-term note that represents a refinancing by the original lender of the original borrower, covering unpaid principal of the existing instrument — provided intangible tax was paid on the original instrument.

Read that carefully, because the conditions are strict:

  • Same lender
  • Same borrower
  • Only up to the unpaid principal balance of the original note
  • Tax must have been paid originally

In practice this means most refinances do not qualify, because most refinances move to a different lender. If you are cash-out refinancing, the amount above your current principal balance is taxable regardless.

This is the single most common surprise on a Georgia refinance Loan Estimate. Borrowers who refinanced once before, with the same servicer, sometimes remember not paying it and expect the same outcome. Changing lenders changes the answer. It is worth asking about at application rather than at the closing table.

HB 586 and the 62-month rule

Georgia’s intangible recording tax applies to long-term notes. Short-term notes are exempt.

Under a recent amendment, a loan is treated as short-term — and exempt — if the principal balance is due within 62 months from origination. That is a significant increase from the previous 36-month threshold.

For most homeowners refinancing into a 15- or 30-year loan, this exemption does not apply. It matters for shorter-term financing.

Do you need an attorney to refinance in Georgia?

You already have an owner’s policy from your purchase. You keep it — an owner’s policy lasts as long as you hold an interest in the property.

What you buy again is the lender’s policy, because your new lender needs coverage for its new lien position. Georgia title rates are not set by the state, so pricing varies by underwriter (WFG and FNTI Georgia residential rate manuals, 2022).

Ask your closing attorney about a reissue rate. Many underwriters discount a lender’s policy when a prior policy on the same property was issued within a defined lookback period. It is not automatic. You generally have to ask, and you may need to produce the prior policy.

Producing the old policy is the friction point. Most homeowners do not know where it is. If you can find your original closing package before you apply, you may save a few hundred dollars — and it is easier to look now than during a 30-day window.

The three main types of Georgia refinance

Rate-and-term refinance. You replace your existing loan with a new one, changing the rate, the term, or both. You do not take cash out beyond a small incidental amount. This is the most common type and generally the least expensive.

Cash-out refinance. You borrow more than you owe and take the difference in cash. Guidelines are tighter — lenders typically require more equity, and the amount above your existing principal is fully subject to intangible tax.

Streamline refinance. Available on FHA and VA loans. FHA Streamline and the VA Interest Rate Reduction Refinance Loan (IRRRL) reduce documentation substantially, and in many cases skip the appraisal. They are only available if your current loan is already FHA or VA respectively.

How do you calculate the break-even point on a refinance?

The honest test is break-even: divide your total refinance fees by your monthly savings. The result is how many months it takes to get your money back.

A worked example (illustrative only). Suppose your fees total $4,500 and the new loan reduces your payment by $180 a month. Break-even is 25 months. If you plan to stay in the house more than roughly two years, the math favors refinancing. If you are likely to move in eighteen months, it does not.

Three things that break this calculation:

  1. Resetting the term. Going from 22 years remaining back to a fresh 30 years lowers your payment but can raise total interest paid over the life of the loan. Lower payment is not automatically less money.
  2. Rolling costs into the loan. You still paid them. You are now paying interest on them too.
  3. Counting escrow as savings. Your escrow refund from the old loan is your own money coming back, not a benefit of refinancing.

What documents you will need

A refinance is documented much like a purchase:

  • Recent pay stubs, or two years of tax returns if self-employed
  • Two months of bank statements
  • Current mortgage statement
  • Homeowners insurance declarations page
  • Photo ID
  • Most recent property tax bill

Appraisal requirements vary. Some rate-and-term refinances qualify for an appraisal waiver based on the lender’s automated valuation; FHA Streamline and VA IRRRL often skip the appraisal by program design. Do not count on a waiver until it is issued.

How long does a refinance take in Georgia?

Expect 30 to 45 days from application to closing for a standard refinance. Streamlines can move faster.

Two Georgia-specific timing notes. Your closing attorney needs a clear title exam, and a payoff statement has to come from your current servicer — servicers are not uniformly fast.
